Eight years ago, progressives were recovering from an Election Day that saw a full 11 states ban same-sex marriage at the polls. The environment in early 2013 could not be more different. Coming off of historic successes at the polls in four states in November, momentum behind marriage equality efforts continues to grow in state after state in advance of what is likely to be a landmark Supreme Court decision on the issue this term:

A pension debate in Rhode Island this fall could set the stage for how dozens of other states take up the issue when regular sessions resume in 2012. As Progressive States Network reported last month, calls for dramatic changes to public pension systems and social security are largely an opportunistic move by conservatives to advance a privatization and anti-tax agenda. The debate playing out in Rhode Island has turned into another unfortunate instance of this, driven by a take-it-or-leave-it proposal by State Treasurer Gina Raimando – a venture capitalist by trade – that would slash benefits and partially privatize the system. To support the proposal, a newly formed lobbying organization supported by financiers and business lobbyists is running a full-press political campaign that is choking out discussion of more reasonable alternatives.

As voter ID legislation continues to be rammed through state legislatures across the country, conservatives are celebrating passage of these bills, intended to suppress turnout among traditionally progressive constituencies, as a victory. However, no one is actually winning – not minority, low-income, and other historically disenfranchised voters who will be disproportionately affected by the new laws, and certainly not already-squeezed state budgets forced to find millions of dollars to make these bills a reality

To date, legislators in up to 22 states have expressed interest in introducing legislation based upon Arizona’s anti-immigrant law, SB 1070, despite a current federal court injunction barring implementation of many of its most draconian provisions.

In a blow to states’ leadership over clean energy, the U.S. Department of Justice has filed a brief before the U.S. Supreme Court arguing that states cannot sue power plant operators that generate pollution. The Justice Department alleges that: (1) the Environmental Protection Agency has already started to regulate greenhouse emissions; and (2) states lack standing to assert a federal nuisance claim.

As this Dispatch will detail, after considerable media hype about Arizona-style bills sweeping across the nation, the reality is that from from Nevada to Arkansas to Massachusetts to Kansas and Rhode Island,
anti-immigrant bills and ballot initiatives largely didn't move or
failed to make this fall's ballot. A key reason: most state leaders
and police chiefs recognize that requiring local governments to assume
immigration enforcement responsibilities from the federal government
will distract them from fighting violent crime and undermine trust with
local residents that are essential to successful community policing.

Rhode Island’s HB 7407, now Public
Law No. 2010-203, creates the Green Economy Roundtable to advise
and assist the Governor and General Assembly in advancing Rhode Island’s
green energy economy by developing a statewide action plan.

Immigrant and workers' rights advocates celebrated a victory in Rhode Island this week with the announcement that State Rep. Peter Palumbo's anti-immigrant bill, closely based on Arizona's widely
criticized SB 1070, would not get a hearing. Rhode Island House Speaker Gordon Fox came out in opposition to Palumbo's bill, and decided to table it -- the proposal was drafted roughly ten days ago, just before the end of the state's legislative session.

The choice of whether or not to establish
high-risk insurance pools represents the first major decision that
states are facing with the March 2010 passage of the Patient
Protection and Affordable Care Act (PPACA). While twenty-nine
governors -- 22 Democrats and 7 Republicans -- decided to create the
pools themselves, most conservative governors failed to take advantage
of the option to shape health care for their constituents and instead
just kicked the issue back to the federal government, which will
establish its own high-risk insurance pool in states that fail to take
action.

States and local governments may now use federal E-rate funds to
provide the general public access to schools’ and public libraries’
Internet facilities, according to a recent Federal Communications Commission order.
Schools receiving funding under the E-rate program may extend their
services to the general public during non-operating hours, that is,
after school, weekends, holidays, and summer vacation.

The Rhode Island Senate and House of Representatives voted on Tuesday to override a gubernatorial veto of important electoral reform legislation that will allow voter pre-registration for 16 and 17-year-olds. Rhode Island now becomes the fifth state, and the fourth in three years, to allow minors to pre-register, a process where their voter registration automatically becomes active upon turning 18.

On Monday, March 23rd, the Vermont Senate overwhelmingly passed (26 to 4) a bill legalizing same-sex marriage,
making the state the first in the nation to take legislative rather
than judicial steps toward granting marriage rights to same-sex
couples. Although House Speaker Shap Smith was confident a majority of
representatives would vote in favor of the "marriage equality" act,
Governor Jim Douglas revealed in a press conference Wednesday that he
would veto the bill, though he did say he would accept a legislative
override.

In a positive step forward for federal respect of state regulatory powers, President Obama directed the Environmental Protection Agency (EPA) to reconsider a previously denied waiver to allow California to set more stringent auto emissions and fuel efficiency standards than required by federal law. In a statement by the White House, President Obama said "the federal government must work with, not against, states to reduce greenhouse gas emissions." The directive represents not only greater respect for state authority, but also a sharp break from the climate policies of President Obama's predecessor.

With legislative sessions getting underway around the country, this
Dispatch provides a list of key bills and policies that we encourage
legislators to consider introducing. While not exhaustive of the range
of needed reforms in states, they emphasize initiatives of strategic
importance that are being considered in multiple states. Working with
our various partners, Progressive States Network is providing staff
support for these policies and will work to use movement in multiple
states to generate national media and attention. This in turn will
create greater momentum to assist individual states in pushing bills to
passage. The following is a quick checklist of key policies with links

As states face mounting deficits, corporate lobbyists have been promoting the idea that privatization of public services and assets is a free lunch -- services can be delivered more cheaply than by public employees and public assets like highways can be sold or leased for a hefty return to the taxpayer. As PSN has detailed in our December 2007 report Privatizing in the Dark: The Pitfalls of Privatization & Why Budget Disclosure is Needed, the promises of privatization too often yield to a reality of lost money and degraded services, weak oversight and lost expertise, assets sold off for short-term gains but long-term loss, lost democratic accountability, and the corruption of the political process.

Milwaukee has a paid sick leave referendum
on the ballot for November that would allow employees to take leave for
medical treatment, preventive care, or diagnosis for themselves, as
well as to care for a close family member who is sick or who needs
diagnosis or preventive care. Additionally, employees would be allowed
to use the time to deal with domestic violence or sexual assault (for
example, using accrued time to flee to safety.) Employees at firms
with 10 workers or less could accumulate up to 40 hours, whereas larger
companies would have to provide up to 72 hours of paid sick leave.

By one estimate, the federal government spent over $367 billion in 2005 aloneon subsidizing Americans' retirement savings and tax breaks to build upother assets like buying a home. Unfortunately, those subsidies gooverwhelmingly to those Americans who already have high-incomes; almostnone of it goes to the poorest Americans who need the most helpbuilding the financial assets that can lead to long-term economicopportunities and security.

With food and gas prices rising rapidly, low-wage workers can at least
welcome an increase in the federal minium wage to $6.55 per hour
scheduled to go into effect on July 24th. Even better, a number of
states will also be increasing their minimum wage rates even higher than the federal rate:

The Rhode Island General Assembly adjourned after lawmakers reached agreement on a $6.9 billion state budget
which, among other things, closes a $422 million deficit for the next
fiscal year. Overall the Rhode Island legislative session ended in
mix results, with Governor Carcieri vetoing some important foreclosure
and environmental legislation. In fact, over a four-day period last
week the Republican Governor vetoed 49 of the bills
approved late last month before the Democrat-dominated Assembly
adjourned. The legislature may, if they choose, hold a special session
before January to rescue the swath of bills.

The Iowa Senate on Tuesday approved SF 2416,
a bill to sharply increase fines on employers violating Iowa state wage
laws, crack down on the practice of misclassifying employees as
"independent contractors" to evade those laws, and protect workers
reporting violations from retaliation.
