Eye On The Right http://www.progressivestates.org/policy/issue/73/eye_on_the_right en Federal Health Law Helping Cash-Strapped States -- And Right-wing State Leaders Lining up to Benefit http://www.progressivestates.org/node/25709 <table> <tbody> <tr> <td> <table style="float: right; clear: none; margin: 0px 14px 14px; border: 1px solid #e7e7e7" class="articleSummaryPicture" align="right"> <tbody> <tr> <td><img src="http://progressivestates.org/sync/images/dispatch/StethescopeOnCash.jpg" style="margin: 5px; padding: 0px; border: 1px solid #e7e7e7" height="188" width="250" /></td> </tr> </tbody> </table> <p> &nbsp; </p> <p> As the six-month anniversary of the signing of the Patient Protection and Affordable Care Act approaches on September 23rd, <a href="http://www.healthcare.gov/law/about/order/byyear.html" id="iq2y" title="many provisions of the new law">many popular provisions of the health care law</a> are set to take effect, including the expansion of coverage to young adults up to the age of 26 on their parents' plans; prohibiting insurance companies from denying coverage to children based on pre-existing conditions or rescinding coverage on those who get sick; eliminating lifetime limits on insurance coverage, and requiring insurers to provide free preventative care through all their plans. <br id="q:om" /> <br id="ab1d" /> One key benefit to state budgets is a new program to subsidize employer-provided health coverage for early retirees age 55 and older who are not eligible for Medicare. Employers eligible for the program include state governments, which will likely save hundreds of millions of dollars in coming years. <br id="a6c." /> <br id="xyp8" /> <b>Conservative State Leaders Calling for Repeal Enjoy Law's Benefits: </b>Yet while the right wing continues their rhetoric of repeal, many of the same states calling loudly in both legislatures and courts for the law's rejection are simultaneously preparing to implement it and benefiting from the opportunities the health care overhaul provides them. In fact, a <a href="http://www.hhs.gov/news/press/2010pres/08/20100831a.html" id="jzsk" title="Department of Health and Human Services">Department of Health and Human Services</a> release revealed that, of the 20 states who have joined the constitutionally dubious multi-state lawsuit seeking to overturn the health care law, eight of them -- <b>Arizona</b>, <b>Idaho</b>, <b>Indiana</b>, <b>Louisiana</b>, <b>Michigan</b>, <b>Nebraska</b>, <b>Nevada</b>, and <b><a href="http://blog.senatedemocrats.wa.gov/the-hopper/irony-state-sues-over-benefits-from-health-reform/" id="u-qt" title="Washington">Washington</a></b> -- were claiming subsidies for retired state government employees provided by the very law their states are arguing should be thrown out by the courts.<br id="hi2." /> <br id="e.95" /> This hypocritical approach to federal health care implementation is not a recent development. Earlier last month, it was reported that a full <a href="http://wonkroom.thinkprogress.org/2010/08/16/rate-review-repeal/" id="gz6a" title="19 states">19 states</a> who are suing the federal government to overturn the health care law also applied for grant money provided for in the law to &quot;help improve the review of proposed health insurance premium increases, take action against insurers seeking unreasonable rate hikes, and ensure consumers receive value for their premium dollars.&quot; And as noted in previous <i>Dispatches</i>, states like <b>Utah</b> and <b>Texas</b>, who have joined the lawsuit seeking to overturn the law, are also taking real, constructive steps towards implementation.<br id="zhb0" /> <br id="ml_s" /> Conservative leaders in a few states are choosing ideological rigidity over the needs of their constituents. <b>Minnesota</b> Gov. Pawlenty recently <a href="http://www.startribune.com/politics/blogs/101900343.html?elr=KArks:DCiUec7PaP3E77K_0c::D3aDhUiD3aPc:_Yyc:aUU" id="rwaq" title="ordered all state agencies">ordered all state agencies</a> not to apply for any federal health care funding from the federal government if it was related to provisions in the new health care law. This short-sighted move has been vociferously opposed by many in the state, including Minnesota's largest private employer, the Mayo Clinic, who <a href="http://minnesota.publicradio.org/display/web/2010/09/03/mayo-pawlenty-health-care-reform/" id="wwh-" title="noted that">noted </a> they had already lost a projected $25 million in federal funding due to the Governor's directive. The Governor's order could end up costing the state <a href="http://www.startribune.com/lifestyle/health/101940198.html?elr=KArksLckD8EQDUoaEyqyP4O:DW3ckUiD3aPc:_Yyc:aUUsZ" id="a-qg" title="over $1 billion">a total of over $1 billion</a>.<br id="dmm8" /> <br id="rma1" /> <b>Right-wing Business Leaders Also Seeking Government Subsidies:  </b>Hypocrisy on the new health care law also extends to the funders of the right-wing movement. As <a href="http://thinkprogress.org/2010/08/31/koch-reinsurance/" id="my_s" title="ThinkProgress">ThinkProgress</a> recently reported, the same HHS release outlined over 2,000 employers -- &quot;large and small businesses, state and local governments, educational institutions, non-profits, and unions&quot; -- in all 50 states already accepted as participants in the $5 billion Early Retiree Reinsurance Program under the new law.  The HHS release also revealed that the applicants included the secretive energy-industry conglomerate Koch Industries, which spent millions of dollars opposing the new law. Gov. Chris Gregoire said Wednesday that she is open to an idea being weighed by legislative leaders: a budget proviso that would block McKenna from spending state money on a 13-state lawsuit challenging the constitutionality of the health care reform effort signed into law Tuesday by President Barack Obama.</p> <p>Rep. Kelli Linville, chairwoman of the state House budget committee, asked for the contract authority to be pulled and is among those considering a budget proviso. The Bellingham Democrat said McKenna has a right to speak his mind, but not to spend state money counter to the wishes of the Legislature and governor.</p> <p>&ldquo;The only thing I&rsquo;m concerned about is not expending revenues now on something like this, that basically I don&rsquo;t agree with, instead of other things that we could spend money on,&rdquo; Linville said.</p> <p>Hours after Congress approved the bill to overhaul the nation&rsquo;s health care system, McKenna announced he would join other state attorneys general in challenging it.</p> <p>The bill&rsquo;s mandate that people buy health insurance or face fines is unconstitutional, McKenna said. Never before has Congress required people to buy a product, he said.</p> <p>Gregoire and legislative leaders rushed to complain that McKenna doesn&rsquo;t represent them. Far from it, they said: Washington patients and taxpayers will benefit from the regulations, funding shifts and government aid contained in the law.</p> <p>The dispute comes with political significance for the next governor&rsquo;s race. McKenna is seen as a potential candidate in 2012.</p> <p>A spokesman for McKenna&rsquo;s office said the office is waiting to comment about any potential budget move until seeing what comes of legislators&rsquo; talks.</p> <p>The freeze on contracts won&rsquo;t affect the lawsuit, spokesman Dan Sytman said. McKenna has no intention of going outside his agency for help. He will leave the lead state on the lawsuit, Florida, to shoulder most of the work, Sytman said. Lawyers in his office could contribute occasionally.</p> <p>&ldquo;In terms of a cost to taxpayers &ndash; something that we&rsquo;re very mindful of &ndash; minimal, to put it lightly,&rdquo; Sytman said.</p> <p>But lawmakers&rsquo; concerns prompted Office of Financial Management Director Victor Moore on Tuesday to revoke a blanket exemption for McKenna on the freeze the Legislature ordered in February.</p> <p>The exemption, granted Friday, allowed the attorney general&rsquo;s office to pay private attorneys, expert witnesses, mediators and others to help on cases without getting separate approval from the bean counters in the governor&rsquo;s office.</p> <p>With the exemption gone, the financial office will now scrutinize every request for outside spending.</p> <p>The office could work out a deal with McKenna to limit the freeze to spending related to suing the federal government. Linville said: &ldquo;We obviously wouldn&rsquo;t want to keep him from doing his regular job.&rdquo;</p> <p>Voters elect the attorney general, and McKenna&rsquo;s office said in a statement on his Web site that he is an independent check on other parts of state government.</p> <p>At least one budget writer said blocking funding would cross a line on the separation of powers.</p> <p>&ldquo;There are a lot of court decisions that I don&rsquo;t agree with that the Washington State Supreme Court has made recently. Does that mean I stop funding them?&rdquo; asked Senate budget committee vice-chairman Rodney Tom, D-Medina.</p> <p>The ranking Republican on the subcommittee overseeing McKenna&rsquo;s budget, Rep. Their approach would simply continue the widespread pattern of insurance company abuses and excessive profiteering. &nbsp;That road is clearly not the answer.</p><p>As you well know, <b>over 46 million people in our country have no insurance</b>. &nbsp;There were 900,000 families last year that faced bankruptcy due to medical costs, of which 75% (675,000) had insurance.&nbsp; Abuses in the insurance industry continue unimpeded, from denying coverage to people because of pre-existing conditions, health status or age to discrimination against women to dropping coverage when people become sick.&nbsp; Employers, especially small businesses vital to job creation in this economy, face escalating insurance costs that undermine their ability to expand and thrive.</p><p>After decades of waiting for the federal government to act on comprehensive health care reform, we strongly urge you to continue to press onward.&nbsp;
